General Conditions & Terms
Scope of application
These general terms and conditions apply to all business relations between betteryou and
its customers in the version valid at the time of the conclusion of the contract.
The customer visits betteryou AG and its trainings and events at his own risk.
Betteryou AG expressly rejects any
liability for damages, injuries and accidents. The liability for the loss of valuables in the premises of betteryou AG
is also rejected.
Performance of analytics & nutrition as well as training
The subject of the order is the provision of an agreed service, e.g. advice and not the achievement of a certain
physical success. The commissioned services shall be deemed to have been rendered when the agreed analyses and
consultations have been carried out and any questions that may arise have been dealt with. They undertake in their own
interest to provide all information (personal details and state of health) truthfully and completely.
The consulting service
The consulting service is provided personally by an employee of betteryou AG. The information does not constitute
medical advice and does not replace medical treatment or therapy.
Despite the greatest care, no guarantee can be given for the correctness and completeness of this information. The
success of the betteryou concept essentially depends on the cooperation of the person to be advised and cannot be
guaranteed. Likewise, no guarantee is given for physical or psychological (consequential) damage to health, if this
occurs after consultation with betteryou AG.
Duty of confidentiality
betteryou AG and its employees are subject to absolute confidentiality. The duty of confidentiality also applies beyond the termination of the cooperation.
Property protection
You undertake that the information material, reports and analyses produced in the context of the cooperation with
betteryou AG will only be used for your own purposes. You receive the exclusive and non-transferable right of use. All
documents and tables are exclusively personal and can only be used by third parties after consultation.
Terms of payment
The personal consultation must be paid for in cash, by EC or credit card at the latest on the first appointment.
Follow-up consultations and services can also be settled in cash, by EC or credit card. Payment on account only on
request and to be paid within 10 days to the following account:

In the case of agreed telephone consultations (remote consultations), the invoice will generally be issued in advance by
betteryou AG. The amount must be received within 10 days without deduction or at the latest before the agreed date on
the above account. If this is not the case, no appointment will be made. With the output, the invoice issued by
betteryou AG to the customer and the agreed service, the customer undertakes to pay the invoice amount to the above
account.
If the customer is in default of payment, CHF 5.00 in reminder charges shall be deemed agreed for each reminder letter.
Place of jurisdiction is Zurich.
Non-utilisation of services
If the customer does not make use of individual services for reasons for which betteryou AG is not responsible, there is
no claim to a proportional refund of the agreed amount. If a customer does not want to make use of the agreed and
previously transferred service – and the cooperation with betteryou AG terminates – a refund fee of 10 percent of the
agreed amount will be charged. If you do not wish to make use of the agreed service, please inform us 48 hours before
the start of the service at the latest. This can be done by telephone or e-mail. In the event of a later declaration, 50
percent of the agreed amount shall become due. If a service is not used without notice, a cancellation fee of 100
percent of the agreed amount is due.
Appointment cancellations
As the client, you reserve a binding appointment for a meeting with an agreed time. If you are unable to meet an
appointment or wish to reschedule it, please inform us at least 48 hours in advance. This can be done by telephone or
e-mail. In case of later cancellations, 50 percent of the fee will be due. Cancellations of appointments due to acute
illness are excluded.
Warranty
betteryou AG and its employees endeavour to make all activities available with the greatest care and in compliance with
recognised nutritional findings and principles. All recommendations and analyses are made to the best of our knowledge
and belief. We do not guarantee the content of such recommendations: The success of analytics & nutrition as well as
training lies largely outside our sphere of influence and depends largely on your cooperation and can therefore not be
guaranteed. Counselling is help for self-help.
Liability
Any liability for the success of the consultation as well as for possible negative consequences (including direct or
indirect consequential damages) caused by the consultation activity is excluded in any case. Liability for any type of
damage, including consequential damage, resulting from the use of the information is excluded.
Arbitration clause
In the event of differences of opinion, the Parties undertake to conduct a conciliation procedure with the aim of
drawing up a fair and equitable agreement by way of mediation with the support of a neutral conciliator, taking into
account the economic, legal, personal and social circumstances.
Severability clause
If one of these regulations should be ineffective, then the effectiveness of the remaining regulations is not touched. The ineffective clause shall be replaced by a provision which comes as close as possible to the ineffective clause in economic and legal terms.
Concluding Revisions
Amendments and supplements to this contract must be made in writing in order to be effective. Verbal collateral agreements do not exist.
The provisions of the Swiss Code of Obligations shall apply. Zurich is the exclusive place of jurisdiction for all disputes arising from a contract with betteryou.
